Welcome to OnPatrolNet. These Terms of Service (the “Terms”) govern your access to and use of this website (the “Platform”). By registering for an account or otherwise accessing the Platform, you agree to comply with these Terms. If you do not agree to these Terms, do not use the Platform.

1. Introduction and Acceptance of Terms

1.1 Restricted to Law Enforcement

This Platform is intended exclusively for use by active-duty sworn law enforcement personnel. Unauthorized access, registration, or use is strictly prohibited and may result in civil or criminal penalties.

1.2 User Confirmation

By using the Platform, you confirm that:

  • You are eligible to use the Platform as described under Eligibility and Account Approval.
  • You will comply with these Terms and all applicable local, state, and federal laws.

1.3 Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on the Platform and become effective 30 days after posting (or earlier if required by law). If you do not agree to the changes, you must stop using the Platform before the effective date. Your continued use after the effective date constitutes acceptance.

1.4 No Emergency Service

The Platform is not designed for or intended to support emergency communications. Do not use it to request dispatch, backup, or time-sensitive operational coordination.

2. Eligibility and Account Approval

2.1 Eligibility

Access is limited to Authorized Users, which includes: (a) active-duty sworn law enforcement officers; (b) civilian personnel authorized in writing by their agency (e.g., crime analysts, dispatch); (c) task-force officers under an interagency MOU; and (d) reserve/retired officers with current, active agency credentials where permitted by agency policy. By registering, you represent and warrant that you meet the foregoing and that your agency authorizes your access and use under its policies.

2.2 Verification Process

All accounts are subject to a verification process to confirm eligibility. You may be required to provide proof of employment and/or identity, including but not limited to:

  • Official identification
  • Badge numbers
  • Employment letters or agency confirmation

Failure to provide accurate or complete information during registration may result in denial or revocation of access.

2.3 Discretionary Approval

Account approval is granted at the sole discretion of the Platform administrators. We may deny or revoke access for any reason, including suspected fraud, misuse, or failure to meet eligibility criteria.

3. Account Responsibilities

3.1 Account Security

You are responsible for maintaining the confidentiality of your login credentials, including your username and password.

  • Do not share your credentials with any unauthorized party.
  • Notify us immediately if you suspect unauthorized access to your account.

3.2 Liability for Account Activity

You are solely responsible for all actions taken through your account. We are not liable for any loss, damage, or consequences resulting from unauthorized access caused by your failure to secure your credentials.

4. Permitted Use and Data Submission

4.1 Permitted Use

The Platform may only be used for lawful purposes in connection with law enforcement duties. Examples include:

  • Sharing non-confidential data or images relevant to law enforcement activities.
  • Collaborating with other authorized users to promote public safety.

4.2 Data Submission Requirements

By submitting data, information, or images to the Platform, you represent and warrant that:

  • Your submissions are truthful, accurate, and non-fictional.
  • Your submissions do not violate any laws or third-party rights.
  • You have authority to share the data in accordance with your agency’s policies.

5. Prohibited Activities

The following activities are strictly prohibited:

  • Sharing Platform content with unauthorized individuals.
  • Uploading false, misleading, or unlawful data or images.
  • Uploading, copying, or transcribing content obtained from restricted systems (e.g., NCIC, Nlets, MULES, state DMV/DOR, RMS) or Criminal Justice Information (CJIS/CHRI) unless expressly authorized by law, covered by a current CJIS agreement with us, and submitted through a CJIS-approved environment provided by us.
  • Posting confidential or sensitive information without proper authorization or lawful purpose.
  • Harassment, doxxing, or uploading PII without lawful purpose/authority.
  • Uploading malware, automated scraping, attempting to bypass or breach security, reverse engineering, or interfering with Platform functionality.

Violation may result in immediate suspension, termination, or legal action.

6. Privacy and Data Storage

6.1 Data Retention

We retain submissions consistent with operational needs and legal requirements. Agency administrators may request export or deletion of specific user-submitted content, subject to legal holds, audits, and backups.

6.2 Security

We implement administrative, technical, and physical safeguards, including encryption in transit and at rest, role-based access controls, and audit logging. No system is entirely immune to breaches; you accept these inherent risks.

6.3 Incident Response

If we become aware of unauthorized access to Platform systems that impacts your data, we will notify your agency without undue delay and provide information reasonably available for incident response, unless prohibited by law.

6.4 Data Location & Backups

Data is stored in the United States with periodic encrypted backups and defined retention schedules.

7. Liability and Disclaimer

No Verification of User Content: We do not verify the accuracy, legality, or completeness of user-submitted content.
Assumption of Risk: You assume responsibility for consequences arising from use, sharing, or dissemination of information obtained here.
Platform Availability: The Platform is provided on an “as-is” and “as-available” basis. We may remove or restrict content reasonably believed to violate law or these Terms. Report concerns to Support@onpatrolnet.com.

8. Termination of Access

8.1 Grounds for Termination

We may suspend or terminate any account without notice for, including but not limited to:

  • Violation of these Terms.
  • Misrepresentation of eligibility.
  • Misuse or abuse of Platform resources.

8.2 Consequences of Termination

  • Your account access will be revoked immediately.
  • Data associated with your account may be retained, archived, or deleted at our discretion, subject to legal holds and audits.

9. Intellectual Property Rights

9.1 Ownership of User Content

Users retain ownership of their content. By submitting content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, and process your content solely to operate, secure, and improve the Platform. Upon deletion or account closure, we will cease public display and delete within a reasonable time, except for backups, legal holds, and audit logs.

9.2 Restrictions

You agree not to upload, post, or share content that infringes on others’ intellectual property rights. For IP complaints (including DMCA), contact Support@onpatrolnet.com.

10. External Links Disclaimer

The Platform may contain links to third-party websites for informational purposes. We do not endorse or assume responsibility for third-party content, security, or practices. Use at your own risk.

11.2 Informal Resolution

Before filing a claim, you agree to email us and allow 30 days to try to resolve the dispute informally.

11.3 Arbitration and Class Waiver

Except where prohibited by law or for claims seeking injunctive relief, disputes will be resolved by binding arbitration administered by JAMS or AAA in St. Francois County, Missouri. Class actions and class arbitrations are not permitted. This section does not apply to agencies where arbitration/class waiver is legally or contractually prohibited.

12. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Platform will not exceed the greater of $100 or the amounts you paid to us in the 12 months before the event giving rise to liability. Some jurisdictions do not allow certain exclusions; limits apply only as permitted.

13. Indemnification

You agree to defend, indemnify, and hold harmless OnPatrolNet, its officers, directors, employees, agents, and affiliates from and against claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of third-party rights; or (d) claims that your content caused damage to a third party.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in St. Francois County, Missouri for claims not subject to arbitration.

15. Severability

If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

16. No Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver is effective only if in writing and signed by an authorized representative of OnPatrolNet.

17. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms at our discretion and without restriction.

18. Entire Agreement

These Terms, together with any policies or updates referenced herein, constitute the entire agreement between you and OnPatrolNet regarding your use of the Platform and supersede any prior agreements or understandings.

19. Third-Party Services

The Platform may rely on third-party services (e.g., hosting, storage, email, payments). We are not responsible for their acts or omissions. Your use may be subject to their terms.

20. Records Requests and Legal Process

We may preserve and disclose information as reasonably necessary to comply with lawful requests (e.g., subpoenas, court orders). Unless legally prohibited, we will provide prompt notice to your agency to allow it to seek protective orders or otherwise respond.

21. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including internet or hosting provider failures, power outages, labor disputes, acts of government, or natural disasters.

We strive to align with WCAG 2.1 AA where feasible. Report accessibility issues to Support@onpatrolnet.com.

23. Agency Agreements

If OnPatrolNet and your agency execute a signed agreement (e.g., MOU/SOW), that agreement controls to the extent of any conflict with these Terms.

24. Survival

Sections relating to account responsibility, privacy and data storage, intellectual property, disputes, limitation of liability, indemnification, governing law, force majeure, agency agreements, and this survival clause survive termination.
